PRIVACY POLICY

This Policy applies to Zimi Ltd and its subsidiaries (“we” or “us”) and outlines how we manage your personal information.

What types of personal information do we collect and hold?

Personal information is information or an opinion that identifies an individual. The types of personal information which we collect from you depends on the products and services which we provide to you. The types of personal information we collect includes:

  • name and contact details (e.g. addresses, email addresses, phone numbers);
  • details of product and services you purchase from us;
  • data and information about use of those products and services, activity on our website, use of the Zimi app and Zimi-enabled products; and
  • information about the hardware and devices used to access the Zimi app.

How do we collect personal information?

We collect your personal information in several ways, including:

  • through your correspondence with us (including by telephone, email or via our website), including when you purchase or enquire about our products/services;
  • through your use of the Zimi app and Zimi-enabled products;
  • from publicly available sources;
  • from automatic data collection tools (such as embedded web links and cookies); and
  • from third parties (where it is not reasonable or practicable to collect the information from you).

Why do we collect, hold and use personal information?

We collect, hold and use your personal information for the primary purpose of providing services to you and for direct marketing (including by email or SMS) of news and offers which may interest you.

This includes:

  • administrative management of our products and services;
  • monitoring and enhancing the quality of the services we provide;
  • monitoring the use of Zimi-enabled products;
  • facilitating software updates and product support; and
  • communicating with you and managing our relationship with you.

We may also use or disclose your personal information for other purposes where you have consented to such use or disclosure or where the other purpose is related to one of the primary purposes referred to above and you would reasonably expect such use or disclosure.

Marketing communications

Personal information that you or a third party have provided to us may be held by us and used to contact you, including via electronic communications, for marketing purposes (even if you are no longer using any of our products or services) until you opt out of receiving such communications.

We will ensure any direct marketing communications contain a simple means by which you may opt out of receiving direct marketing communications. You may also opt out or unsubscribe from our mailing/marketing lists at any time by contacting us via the details listed at the end of this Policy.

How do we hold personal information?

We will hold personal information as either physical records, records on our server and in some cases, records on third party servers (which may include Google Cloud, Amazon Web Services and/or Microsoft), some of which may be located overseas.

When do we disclose personal information?

We may disclose your personal information in a number of circumstances, including:

  • to our related bodies corporate, affiliates, agents, contractors and commercial partners;
  • to third party service providers we use to provide Zimi;
  • to manufacturers, wholesalers and retailers of Zimi-enabled and associated products;
  • to offer specific products and services we consider may be of interest to you;
  • to facilitate a transfer or sale of all or some of our assets and/or business;
  • to third parties such as energy market participants, governments, councils and regulatory authorities and research institutions in furtherance of our business needs;
  • where we are required or authorised by law to disclose that personal information; and
  • as expressly identified in the Terms of Use for the Zimi app and/or any other privacy collection statement provided to you.

We may also disclose your information to, and collect your information from, information matching providers. For example, to verify the information you have provided to us and to confirm your identity.

If you provide us with personal information about another person:

  • you acknowledge and agree that you are authorised by that person to do so;
  • you have told them their information has been provided to us; and
  • you have made them aware of this Policy.

We are not responsible for any information provided by you to third parties and such information is not subject to this Policy. You assume all privacy, security and other risks associated with providing any information, including personally identifiable information, to third parties via the Zimi app.

How do we store personal information?

We take measures to protect personal information held by us from misuse, loss and unauthorised access, modification or disclosure. However, we do not guarantee that the personal information you provide will not be intercepted by others and decrypted.

When we no longer require your personal information for the purposes for which it was obtained (which purposes include direct marketing and data analysis), we will take reasonable steps to destroy or permanently de-identify your personal information. However, most personal information we hold is or will be stored in files which will be kept by us for a minimum of 7 years from when it was collected or provided to us.

How can you get access to your personal information?

You may access the personal information we hold about you, subject to certain exceptions. If you wish to access your personal information, please contact us in writing. We will respond within a reasonable period of you making such a request. We will not charge any fee for making a request for access your personal information. Provided it is reasonable and practicable to do so, we will provide access to your personal information in the manner which you request. Zimi may charge an administrative fee for providing you with a copy of your personal information. In order to protect your personal information, we may require information from you to verify your identity before releasing requested information to you.

Maintaining the quality of your personal information

It is important to us that your personal information is up to date. If you believe that information we have about you is not up to date, or is otherwise incomplete or inaccurate, please advise us as soon as practicable using the contact details listed at the end of this Policy so we can update our records and ensure we can continue to provide quality services to you.

Policy updates

We may modify and update this Policy at any time. Any updates to this Policy will be available at www.zimi.life/privacy-policy/. If you require a copy of this Policy in an alternative format, we will take such steps as are reasonable to provide you with a copy in that format.

Complaints

If you believe that your personal information has not been handled by us in accordance with this Policy or applicable laws, you may make a complaint to us in writing using the contact details set out in this Policy. We will process complaints in a reasonable time (usually within 30 days from the date the complaint was received) and you will be advised in writing of our decision and any action taken. If you are unsatisfied with our response, you may contact the Office of the Australian Information Commissioner.
